What is a Totting Up Ban?

A totting up ban means that a driver must be disqualified for a minimum of 6 months if they accumulate a total of 12 or more penalty points on their licence within a 3 year period. The court uses the date of the actual offences rather than the date that the driver was sentenced or convicted.

IF YOU HAVE BEEN CHARGED WITH A MOTORING OFFENCE AND WANT TO AVOID A TOTTING UP BAN, WHAT CAN YOU DO?

There are three ways you can defend a totting up ban:

1. Defend the allegation made against you. This can be difficult to do and we can advise you fully whether you have a defence or not when we know all the circumstances.

2. Argue Special Reasons in order to persuade the court not to give you any additional points on your licence. For example, if you ran a red light because you were moving out of the way of an emergency vehicle you would be able to raise this argument. There are many other arguments that can be raised for special reasons and we can advise you of them when we know all the circumstances.

3. Persuade the court that there are circumstances to be lenient and give reasons why it should not impose a driving disqualification or why any ban should be for a shorter period. We can advise about this when we know all the circumstances.
