Accidents involving off-road vehicles and insurance

On the 21st February 2021 the government announced plans to scrap EU requirements for off-road vehicle to be insured.


Personal injury lawyers across the country have expressed concern that these changes, made in the name of Brexit, could have serious implications for people who have been injury by off-road vehicles.


The ‘Vnuk’ law originated from a Slovenian case in 2014 where a farm worker was injured when he was knocked off a ladder by a reversing tractor trailer. The European Court of Justice ruled in his favour, meaning that he could claim damages under the motor insurance policy.


This ruling also extends to protect people involved in accidents with other vehicles such as quad bikes even if they are only used on private land.
